Terms of Service

Last updated: May 22, 2026. These terms govern your use of Miskari. Please read them carefully. If you do not agree, do not use the service.

What Miskari is

Miskari is a multi-tenant property management software-as-a-service platform for commercial property owners and operators. It is operated at miskari.com and the authenticated application at app.miskari.com. The service helps customers track properties, bills, vendors, contracts, tenants, leases, tax assessments and protests, maintenance, insurance, and related records.

In these terms, "we," "us," and "Miskari" refer to the operator of the service. "You" and "customer" refer to the organization that has registered an account, and to the individual users acting on its behalf.

Acceptance

By creating an account, accessing the service, or paying a subscription fee, you agree to be bound by these terms. If you are accepting on behalf of an organization, you represent that you have authority to bind that organization to this agreement.

If you do not have that authority, or if you do not agree with any part of these terms, you must not use the service.

Your account

Each user account is for a single human being. You may not share credentials, and you may not allow another person to log in under your account. Organizations needing multiple seats should invite additional users from within the application.

You are responsible for keeping your password secure and for all activity that occurs under your account. Notify us promptly at support@miskari.com if you suspect any unauthorized access.

You agree to provide accurate and current information about your organization, including legal entity name and contact details, and to keep that information up to date while your account is active.

Subscription and billing

Paid subscriptions are billed through Stripe on a recurring monthly or annual basis at the price displayed at checkout. By subscribing you authorize Stripe to charge your payment method on the recurring schedule you selected, until you cancel.

You can cancel at any time from the Stripe Customer Portal linked from your billing settings. Cancellation takes effect at the end of the current paid period.

Refunds. Annual subscriptions canceled mid-term are eligible for a prorated refund of the unused portion. Monthly subscriptions are non-refundable except where a refund is required by applicable law. If you believe you have been billed in error, contact support@miskari.com within 30 days and we will work in good faith to resolve it.

We may change subscription pricing with at least 30 days' notice by email. The new price applies to the next renewal after the notice period.

Acceptable use

You agree not to:

  • Resell, sublicense, or otherwise commercialize access to the service.
  • Scrape, crawl, or extract data from the service in bulk except through the export features we provide.
  • Reverse engineer, decompile, or otherwise attempt to derive the source code, except to the extent that applicable law permits.
  • Use the service to store, transmit, or process content that is illegal, infringing, defamatory, or that violates the rights of others.
  • Interfere with the security or integrity of the service, attempt to bypass access controls, or probe for vulnerabilities outside a coordinated disclosure process.
  • Use the service to send unsolicited commercial communications or otherwise abuse the notification system we provide.

We may suspend access without notice if we reasonably believe your use is causing harm to other customers, to the service, or to third parties.

Your data

You retain all rights to the content and records you upload or enter into the service - properties, bills, assessments, documents, and so on. We claim no ownership over your data.

You grant us a limited, non-exclusive license to host, process, transmit, and display your data solely as needed to operate and provide the service to you, to perform backups and security operations, and to improve the service in aggregated and anonymized form. We do not sell your data and we do not use it to train machine learning models that are exposed to third parties.

You are responsible for the accuracy, legality, and appropriateness of the data you store in the service, and for having the right to upload it.

Service availability

We operate the service on a best-effort basis and aim for high availability, but we do not offer a specific uptime guarantee at this tier. We may perform planned maintenance, and we will try to schedule significant maintenance windows during low-traffic hours and to notify customers in advance when possible.

The service may rely on third-party infrastructure (database, object storage, email delivery, payment processing). Outages or degradation of those providers can affect availability.

Termination

You may terminate your subscription at any time through the Customer Portal. Termination ends future billing but does not refund the current paid period except as described in the refund section above.

We may suspend or terminate your account for non-payment, for material breach of these terms, or if continued service exposes us to legal risk. For non-payment we will provide a reasonable cure period before suspension. For other breaches we may terminate immediately if the breach is serious or repeated.

On termination you may export your data through the export features for a period of 90 days after the subscription ends. After that, your data may be deleted as described in the Privacy Policy.

Disclaimers

The service is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

Miskari is a tool that helps you organize property records. It is not a substitute for professional legal, tax, accounting, or property management advice. Decisions you make based on data in the service (including tax protests, contract renewals, and maintenance scheduling) are your own.

Limitation of liability

To the maximum extent permitted by law, our total aggregate liability for any claim arising from or related to the service is limited to the subscription fees you paid us in the twelve months immediately preceding the event giving rise to the claim.

We are not liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including lost profits, lost revenue, lost data, or business interruption, even if we have been advised of the possibility of such damages.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages, so some of the above may not apply to you.

Indemnification

You agree to defend, indemnify, and hold us harmless from any claim, demand, or expense (including reasonable attorneys' fees) arising out of your use of the service, your data, or your violation of these terms.

We agree to defend, indemnify, and hold you harmless from any third-party claim that the service, as provided by us and used in accordance with these terms, infringes that third party's intellectual property rights.

Governing law and venue

These terms are governed by the laws of the State of Texas, without regard to its conflict of laws principles. Subject to the dispute resolution section below, the exclusive venue for any court action is Dallas County, Texas, and each party consents to personal jurisdiction there.

Dispute resolution

If a dispute arises, the parties will first attempt to resolve it informally by good-faith negotiation. Either party may initiate this by giving the other written notice describing the dispute and the relief sought.

If the dispute is not resolved within 30 days of that notice, the parties agree to submit the dispute to binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, seated in Dallas County, Texas. The arbitrator's award may be entered as a judgment in any court of competent jurisdiction.

Either party may seek injunctive relief in court for misuse of confidential information or infringement of intellectual property without waiting on arbitration.

Changes to these terms

We may update these terms from time to time. For material changes we will provide at least 30 days' notice by email to the address on file or by an in-app notice. Continued use of the service after the effective date constitutes acceptance of the updated terms. If you do not agree, you may cancel before the effective date.
